QUARTZWAY RESIDENTIAL 15-YEAR LIMITED WARRANTY

1. Warranty Coverage

Quartzway warrants its quartz surfacing material against manufacturing defects for a period of fifteen (15) years from the original date of installation, subject to the terms, conditions, limitations, and exclusions described in this warranty.

This warranty:

  • Applies only to genuine Quartzway quartz surfacing products.

  • Applies only to permanently installed interior residential applications.

  • Applies only to the original owner of the residence in which the Quartzway product was originally installed.

  • Is non-transferable.

  • Begins on the original date of installation.

  • Applies only while the product remains in its original location.

  • Applies only to materials and services that have been paid for in full.

  • Applies only when the product has been fabricated, installed, used, and maintained in accordance with applicable Quartzway instructions and generally accepted professional fabrication and installation practices.

For newly constructed residences, the warranty may apply to the first owner and occupant of the residence in which the Quartzway product was originally installed, provided satisfactory documentation of the original installation can be supplied.

 
 
  1. What Is a Manufacturing Defect?

For purposes of this warranty, a manufacturing defect is a defect originating from the manufacturing of the Quartzway slab that materially affects the structural integrity or intended performance of the product.

A manufacturing defect does not include:

  • Normal color, pattern, or shade variation.
  • Normal characteristics of the manufacturing process.
  • Damage caused after manufacture.
  • Fabrication or installation defects.
  • Damage caused by transportation, handling, use, abuse, maintenance, structural movement, impact, heat, chemicals, or other external causes.
  • Conditions that fall within commercially acceptable manufacturing variation and do not materially affect the performance of the product.

 3. Inspection Before Fabrication and Installation

Quartzway slabs must be visually inspected before fabrication and again before installation.

The fabricator and/or installer is responsible for inspecting the material for visible conditions, including:

  • Cracks.

  • Chips.

  • Surface damage.

  • Color or pattern concerns.

  • Finish concerns.

  • Obvious manufacturing irregularities.

  • Other visible conditions that may affect the finished installation.

If a suspected manufacturing defect is discovered:

  • Fabrication should stop before the affected area is cut or altered.

  • Quartzway or the supplier of the material should be contacted before fabrication continues.

  • The affected material should be made available for inspection.

Fabrication or installation of material containing a condition that was readily visible and reasonably identifiable before fabrication may constitute acceptance of that visible condition.

This provision does not apply to latent manufacturing defects that could not reasonably have been identified through normal visual inspection before fabrication or installation.

 

 4. What Quartzway Will Do

If Quartzway determines that a covered manufacturing defect exists, Quartzway may, at its discretion:

  • Repair the affected Quartzway material;

  • Provide replacement Quartzway material; or

  • Refund the original purchase price attributable to the affected Quartzway material.

Quartzway will determine the appropriate remedy based on the nature of the defect and the circumstances of the claim.

If replacement material is provided:

  • An exact color, pattern, shade, finish, or veining match is not guaranteed.

  • If the original color or design is no longer available, Quartzway may provide a reasonably comparable Quartzway product.

  • Replacement material remains covered only for the remainder of the original 15-year warranty period. Replacement does not begin a new 15-year warranty period.

Unless otherwise required by applicable law or expressly approved by Quartzway in writing, this is a product/material warranty only.

 
 

 5. Residential Use Only

This warranty applies only to qualifying residential installations.

It does not cover:

  • Commercial properties.

  • Stores.

  • Offices.

  • Restaurants.

  • Hotels or motels.

  • Other places of business.

  • Rental or leased properties.

  • Short-term rental properties.

  • Other installations primarily used for commercial purposes.

Commercial warranties, if offered by Quartzway, are governed by their own separate terms.

 
 

 6. Outdoor and Unapproved Applications

This warranty does not cover:

  • Outdoor installations.

  • Exterior kitchens.

  • Swimming pools or pool surrounds.

  • Flooring applications.

  • Applications involving prolonged ultraviolet exposure.

  • Applications involving direct flame.

  • Applications involving excessive heat.

  • Applications not reasonably intended for quartz surfacing material.

Damage associated with fireplaces, fireboxes, grills, cooktops, or other high-heat installations is not covered when caused by excessive heat, thermal shock, improper clearance, improper design, or improper installation.

 

 7. Fabrication and Installation Exclusions

Quartzway manufactures and supplies quartz surfacing material. Fabricators and installers are independent professionals responsible for their own workmanship.

This warranty does not cover defects, failures, or damage caused by:

  • Improper fabrication.

  • Improper installation.

  • Improper handling.

  • Improper transportation after the material leaves Quartzway’s control.

  • Failure to follow applicable fabrication or installation requirements.

  • Dry cutting, polishing, or other fabrication practices that damage the material or fail to comply with applicable fabrication requirements.

  • Improper edge fabrication.

  • Improperly fabricated mitered edges.

  • Excessively narrow material around sinks, cooktops, or other cutouts.

  • Improperly designed or fabricated cutouts.

  • Improper sink installation.

  • Mechanical fasteners installed directly into the quartz material in an improper manner.

  • Insufficient support.

  • Unsupported or inadequately supported overhangs.

  • Improper cabinet or substrate preparation.

  • Uneven or improperly leveled supporting surfaces.

  • Alteration or reduction of the original slab thickness.

Fabrication and installation workmanship claims must be addressed to the fabricator or installer responsible for the work.

 
 

 8. Seams, Adhesives and Accessory Materials

This warranty does not cover:

  • Seam appearance.

  • Seam placement.

  • Seam width.

  • Seam performance resulting from fabrication or installation.

  • Seam separation caused by structural or substrate movement.

  • Adhesives.

  • Caulk.

  • Epoxy.

  • Mechanical attachment systems.

  • Other accessory materials supplied or installed by third parties.

Differences in pattern or veining at a seam are not considered manufacturing defects.

 
 

9. Impact, Chips and Scratches

Quartz is highly durable but is not indestructible.

This warranty does not cover:

  • Chips caused by impact.

  • Edge damage caused by impact.

  • Damage caused by dropping heavy or hard objects.

  • Scratches resulting from normal use or misuse.

  • Damage caused by cutting directly on the countertop.

Cutting boards should be used whenever cutting food or other materials.

 
 

 

10. Heat and Thermal Shock

Quartz surfaces can be damaged by excessive or sudden changes in temperature.

This warranty does not cover damage caused by:

  • Hot cookware placed directly on the surface.

  • Hot pans.

  • Baking sheets or oven trays.

  • Electric skillets.

  • Slow cookers or other heat-producing appliances when they expose the surface to excessive heat.

  • Direct flame.

  • Excessive heat.

  • Thermal shock.

 

Trivets, hot pads, or other appropriate heat protection should always be used.

 
 

11. Chemical Damage

This warranty does not cover damage caused by:

  • Paint removers.

  • Paint strippers.

  • Solvents.

  • Strong acids.

  • Strong alkaline chemicals.

  • Oven cleaners.

  • Drain cleaners.

  • Abrasive chemicals or cleaners.

  • Other chemicals not recommended in the Quartzway Care & Maintenance Guidelines.

 

Spills should be cleaned in accordance with Quartzway’s current Care & Maintenance Guidelines.

 
 

12. Care and Maintenance

Warranty coverage requires reasonable care and maintenance of the Quartzway surface.

This warranty does not cover:

  • Routine cleaning.

  • Removal of ordinary stains.

  • Water spots.

  • Temporary surface marks.

  • Damage resulting from improper cleaning products.

  • Damage resulting from improper care or maintenance.

  • Conditions resulting from neglect or abuse.

 

Quartzway Care & Maintenance Guidelines should be followed throughout the life of the installation.

 

13. Color, Pattern and Appearance Variation

Quartz slabs contain natural mineral components and are manufactured using processes that can result in visual variation.

The following are not considered manufacturing defects when they do not materially affect structural integrity or intended performance:

  • Reasonable variation in color.

  • Shade variation.

  • Background-tone variation.

  • Pattern variation.

  • Veining variation.

  • Variation in the size, shape, or distribution of quartz particles or other visual components.

  • Minor spots, particulate concentrations, or blemishes inherent to the manufacturing process.

  • Visual differences caused by natural or artificial lighting.

  • Differences in reflected light.

  • Reasonable variation between different production lots.

Samples, photographs, brochures, websites, showroom displays, and small sample pieces are representations of the product only.

 

They do not guarantee an exact match to the slab ultimately purchased or installed.

14. Customer Selection of Color and Finish

A customer’s decision after purchase or installation that they do not like the selected:

  • Color.

  • Pattern.

  • Veining.

  • Finish.

  • Overall appearance.

is not considered a manufacturing defect.

 

Customers and fabricators should review the actual slab whenever practical before fabrication.

15. Honed and Specialty Finishes

Honed and other non-polished finishes may show normal signs of use more readily than polished surfaces.

The warranty does not cover normal temporary marks associated with these finishes, including:

  • Fingerprints.

  • Metal marks.

  • Smudges.

  • Water marks.

  • Other ordinary signs of use that can be addressed through proper cleaning and maintenance.

Any finish altered after leaving the factory is excluded from this warranty unless the alteration was specifically authorized by Quartzway in writing.

 

Issues resulting from in-shop honing, polishing, texturing, or other alteration of the original factory finish are the responsibility of the party performing the alteration.

16. Modified Material and Unapproved Fabrication

This warranty does not cover damage or failure resulting from:

 

  • Bending.

  • Curving.

  • Thermal forming.

  • Reducing slab thickness.

  • Altering the factory finish.

  • Unauthorized surface treatments.

  • Other modifications materially changing the original slab.

 

17. Structural and Job-Site Conditions

This warranty does not cover damage caused in whole or in part by:

  • Structural movement.

  • Foundation movement.

  • Cabinet movement.

  • Substrate movement.

  • Building settlement.

  • Improper structural support.

  • Defective architectural or engineering design.

  • Job-site conditions.

  • Accidents.

  • Vandalism.

  • Fire.

  • Flood.

  • Natural disasters.

  • Other events outside Quartzway’s reasonable control.

Quartzway is not responsible for determining the structural suitability of cabinets, framing, substrates, buildings, or other supporting structures.

 

18. Transportation and Handling

Quartzway is not responsible under this warranty for damage occurring after the material has been transferred to and accepted by:

  • The customer.

  • The dealer.

  • The fabricator.

  • The installer.

  • A third-party carrier.

  • Any other party responsible for transporting or handling the material.

 

Visible transportation damage should be reported before fabrication or installation.

 

19. Costs Not Covered

Unless specifically approved by Quartzway in writing or otherwise required by applicable law, this warranty does not cover costs associated with:

  • Fabrication.

  • Removal.

  • Tear-out.

  • Demolition.

  • Disposal.

  • Freight.

  • Transportation.

  • Reinstallation.

  • Installation labor.

  • Plumbing.

  • Electrical work.

  • Cabinetry.

  • Backsplash or tile work.

  • Flooring.

  • Painting.

  • Wall repair.

  • Appliance removal or installation.

  • Other construction or finishing work associated with repairing or replacing the Quartzway material.

 

 

20. Product Identification and Documentation

The owner should retain documentation sufficient to identify the Quartzway product and original installation.

Quartzway may request:

  • Original invoice or receipt.

  • Owner’s name.

  • Installation address.

  • Date of installation.

  • Quartzway color or product name.

  • Fabricator and/or installer information.

  • Slab, lot, batch, or serial information when available.

  • Photographs of the alleged defect.

  • Photographs of the complete installation.

  • Additional information reasonably necessary to evaluate the claim.

 

Failure to provide sufficient information to identify the product or evaluate the claim may delay or prevent warranty service.

 

21. How to Submit a Warranty Claim

A suspected manufacturing defect should be reported within thirty (30) days after the defect is discovered.

The owner may first contact the dealer or fabricator from whom the Quartzway material was purchased or contact Quartzway directly.

Warranty claims should include:

  • Proof of purchase.

  • Installation date.

  • Installation address.

  • Product/color name, when available.

  • Fabricator or installer information.

  • Clear photographs of the alleged defect.

  • A description of the problem and when it was discovered.

Quartzway may require an inspection of the product before determining whether the claim is covered.

The owner must provide Quartzway and its authorized representatives reasonable access to inspect the installation and must reasonably cooperate with the warranty investigation.

22. Warranty Decisions

Quartzway will determine whether a claimed condition constitutes a covered manufacturing defect under this warranty.

No dealer, salesperson, distributor, fabricator, installer, contractor, or other third party is authorized to:

  • Modify this warranty.

  • Extend this warranty.

  • Create additional warranty obligations on behalf of Quartzway.

  • Promise a particular warranty remedy on behalf of Quartzway.

 

Any modification to this warranty must be made in writing by an authorized representative of Quartzway.

 

23. Delays Beyond Quartzway’s Control

Quartzway will not be responsible for reasonable delays in providing an approved warranty remedy caused by circumstances beyond its reasonable control, including:

 

  • Product or material shortages.

  • Transportation disruptions.

  • Government actions.

  • Natural disasters.

  • Fires or floods.

  • Labor disruptions.

  • Supply-chain interruptions.

  • Discontinuation or temporary unavailability of a particular product.

 

24. Limitation of Liability

To the maximum extent permitted by applicable law, Quartzway will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use or inability to use a Quartzway product.

 

Nothing in this warranty is intended to exclude or limit any right, warranty, remedy, or liability that cannot legally be excluded or limited under applicable federal, state, or local law.

 

25. Other Legal Rights

This limited warranty gives the owner specific legal rights.

The owner may also have other rights that vary from state to state.

 

If any provision of this warranty is determined to be invalid or unenforceable under applicable law, the remaining provisions will continue to apply to the maximum extent permitted by law.

 

26. Entire Written Warranty

This document constitutes Quartzway’s written 15-Year Residential Limited Warranty for Quartzway quartz surfacing products.

Any additional representation or promise concerning warranty coverage must be made in writing by an authorized representative of Quartzway.
